These features integrate with third-party large language models (LLMs) such as Grok (xAI), ChatGPT (OpenAI), Gemini (Google), Claude (Anthropic), and Perplexity to provide advanced analysis, content generation, and optimization suggestions. Data generated through user interactions may be processed by these LLMs.

To access certain features of the Services, you must create an account by registering at https://wintraction.ai.

You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your account credentials and notify us immediately of any unauthorized access.
• Be responsible for all activities that occur under your account.

We reserve the right to refuse registration or cancel accounts at our sole discretion.

• Free Trial: We may offer a free trial for certain features. The trial period and features are subject to change.
• Paid Services: Paid subscriptions provide access to premium features. Payments are processed through third-party providers and are non-refundable except as required by law. We may change pricing at any time with notice. You authorize us to charge your payment method for the applicable fees.
• Flagship Plan: The Flagship Plan is only valid for a two-month subscription term.

• Customer Data Protection: We do not intentionally share your proprietary content with these LLMs for training purposes. However, once data is transmitted to third-party providers, we cannot guarantee how they handle it.
• Training Data Risk: Third-party LLMs may use shared data to improve their models (potentially anonymized or aggregated).
• Data Exposure: There is a risk of data breaches at third-party providers.

You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your User Content as necessary to provide the Services.

You agree not to:

• Use the Services for illegal, harmful, or abusive purposes.
• Upload content that infringes on third-party rights, including intellectual property.
• Use the Services to create or distribute content that promotes hate, violence, discrimination, or is otherwise prohibited.

We may remove or disable User Content that violates these Terms.

All rights, title, and interest in the Services, including software, designs, and trademarks, are owned by Win Traction, Inc or our licensors. You may not copy, modify, or reverse-engineer the Services.

All Wintraction.ai frameworks, systems, and methodologies developed and shared during any client engagement remain the sole intellectual property of Wintraction.ai. Client engagements do not transfer ownership of any proprietary systems, processes, or frameworks to the client.

We reserve the right to suspend or terminate your account or access to the Services at any time, for any reason or no reason, without notice or liability. Services may also be paused for overdue payments. Upon termination:

• Your right to use the Services ends immediately.
• We may delete your data, subject to applicable laws.

You may terminate your account at any time by contacting us.

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

AI visibility and rankings may change due to platform or algorithm updates. Wintraction.ai works to improve AI visibility, discoverability, and brand positioning, but final business outcomes may vary based on market conditions, competition, and platform changes. Specific business outcomes are not guaranteed.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WIN TRACTION, INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM.

You agree to indemnify and hold harmless Win Traction, Inc, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida.

By engaging with Wintraction.ai services, clients acknowledge and agree to the following:

• Wintraction.ai works to improve AI visibility, discoverability, and brand positioning, but final business outcomes may vary based on market conditions, competition, and platform changes.
• Delays in approvals or access may affect timelines and results.
• Wintraction.ai may pause services for overdue payments.
• Payment conditions and engagement policies listed in these Terms apply in full.
• The "Flagship Plan" is only valid for a two-month subscription.

The pricing for this service is personalized based on the scope, requirements, and discussions finalized with the client.

I agree to:

• Keep confidential any proprietary strategies, reports, or internal systems shared during the engagement.
• Confirm that I am authorized to enter into this engagement on behalf of my business.
• Confirm that I have reviewed and accepted all the terms, responsibilities, and engagement policies listed herein.
• Confirm that I have read and agree to the Wintraction.ai Terms & Engagement Policy.
• Confirm that payments made are non-refundable once work has started.
• Provide the required access, approvals, and business information for execution.
• Acknowledge that all Wintraction.ai frameworks, systems, and methodologies remain the intellectual property of Wintraction.ai.

By proceeding with the payment, you acknowledge and agree to the mutually discussed pricing and deliverables.

• Severability: If any provision of these Terms is held invalid, the remainder shall continue in full effect.
• Waiver: No waiver of any term shall be deemed a further or continuing waiver.
• Entire Agreement: These Terms constitute the entire agreement between you and Win Traction, Inc.
